Guiding You Through The Probate Process

The Law Office Of Paul D. White P.A. has over 21 years of experience handling probate matters for clients in Saline County. With our knowledge, we can help you during this difficult time.

Probate is the process through which assets and properties are distributed after a person dies. The first step is determining if there is a valid will and to petition to admit the will to probate along with a personal representative. This notice must be sent and published to all known creditors.

The next step involves collecting and managing probate property, paying all outstanding taxes and debts, and then distributing the remaining assets to the heirs stated in the will. In the event that there is no will, Arkansas intestate laws determine how the assets will be distributed, as well as an administrator to handle the process.

Simplified Small Estate Probate

If the estate in questions is worth $100,000 or less, excluding allowances and rights due to the spouses and minor children, it may be eligible for simplified probate procedures. This can be done after a waiting period of 45 days. We can help you file an Affidavit for Collection of Small Estate to put this process in motion.
